1. Introduction. “Barndominium Plans” through www.BarndominiumPlans.com (collectively, "Barndominium Plans," "we," "us," and "our") recognizes the importance of protecting the privacy of the personal information you provide to us. Barndominium Plans operates a consumer-facing website through which you may browse, purchase, and license architectural drawings, specifications, and associated documents providing designs and instructions for constructing houses including a barndominium house or other structure (the “Plans”), and request modifications to those Plans. 

"Personal information" means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.  “Personal information” does not include publicly available information (e.g., information from government records or information lawfully made available to the general public), deidentified information, or aggregate consumer information. If we process deidentified information, we publicly commit to maintain and use deidentified information only in deidentified form, not to attempt to reidentify it, and to contractually obligate recipients to do the same.

We have developed this Privacy Policy (the "Policy") so that you can make educated and informed decisions about the personal information that you entrust to us when you use www.BarndominiumPlans.com and any other website, mobile website, social media site, email or text-message exchange of information, and any other digital platform, including any services, features, pages, and functions contained or offered therein, that are owned, operated, or provided by Barndominium Plans (collectively, the "Site"), and so you understand how we collect, use, disclose, and otherwise manage this information.

This Policy is incorporated into our Terms of Service (available at https://barndominiumplans.com/policies/terms-of-service). If there are any terms in this Policy or in our Terms of Service to which you do not agree, you must discontinue your use of the Site. PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY USING OUR SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS OF THIS PRIVACY POLICY. If you do not agree with this Policy, do not use the Site or provide personal information to us.

This Policy is written in the English language. We do not guarantee the accuracy of any translated versions of this Policy. To the extent any translated versions conflict with the English language version, the English language version shall control. Our Site is intended for United States residents only.

2. Scope. This Policy applies to personal information collected through the Site, including when you browse the Site, purchase or license Plans, request Plan modifications, sign up for emails or SMS alerts, or otherwise communicate with us. 

3. Children and Individuals Under the Age of Eighteen. We are committed to protecting the privacy of children. Our Site is not intended for or directed to persons under eighteen (18) years of age. IF YOU ARE UNDER THE AGE OF EIGHTEEN (18) YOU ARE NOT AUTHORIZED TO USE OUR SITE, EVEN IF YOU HAVE OBTAINED PARENTAL CONSENT TO DO SO. We do not knowingly collect, request, process, or disclose data of persons under eighteen (18). Upon notice that a person under eighteen (18) has provided us with personal information, or that another party has otherwise provided us with the personal information of a person under eighteen (18), we will delete that personal information from our records and remove any associated identifiers from advertising audiences. If you are a parent or guardian and believe we have collected personal information of a person under eighteen (18), please contact us at the contact information below and we will remove such data.

4. Sources of Collected Personal Information. Barndominium Plans collects personal information from the following sources.

Information you provide to us directly. Barndominium Plans collects personal information from you directly when you interact with the Site, purchase or license Plans, request Plan modifications, contact us, sign up to receive emails or SMS alerts from us, participate in a promotion we offer, or otherwise communicate with us. When you use the Site, we may collect your name, email address, phone number, postal and billing address, the billing and payment information you provide at checkout, and the content of the messages you send us. When you request Plan modifications, we may also collect any sketches, measurements, lot information, or other materials you choose to submit in connection with the requested modifications. Please do not submit Social Security numbers, government identification numbers, or other sensitive personal information that we do not request through the Site.

Information we obtain indirectly. We may receive information about you from the Service Providers (defined in Section 7) that perform functions on our behalf, such as the e-commerce platform that hosts the Site and processes your orders, our payment processor, the carriers that deliver shipped orders, and the providers that deliver our emails and SMS alerts. We may also receive information from the analytics and advertising platforms described in Section 6 about how you reached the Site and how our advertising performs. We may combine this with information we have already collected, such as your contact details and order history, to process your orders, respond to your requests, and improve the Site.

Information collected automatically. When you use our Site, we collect certain information automatically through Cookies and similar technologies, including your IP address, approximate location derived from your IP address, device and browser type, operating system, screen size, device identifiers, the referring website address, the pages and Plans you view, the dates and times of your visits, and cookie and pixel identifiers, to allow us to operate and provide the Site, to understand how you interact with it, and to measure and deliver advertising as described below. You may reject and opt out of Cookies and other parts of the Site. When you make a purchase, subscribe, sign up to receive offers, emails, or SMS alerts from us, or otherwise communicate with us through our Site, you may “opt out” of receiving future communications from us for direct marketing purposes by indicating that you decline such communications. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or contacting us at the contact information below.

 If you have opted in to our SMS alerts, you may cancel at any time by texting STOP to the short code, and we will send you a message confirming that you have been unsubscribed. Consent to receive text messages is not a condition of purchase. You may also opt out via a 'Do Not Sell or Share My Personal Information' link in our website footer. We honor opt-out preference signals, including the Global Privacy Control, as a valid request to opt out of sale/sharing for the browser or device transmitting the signal. 

Non-personal information. In some circumstances, we may collect aggregated data or anonymize your personal information (so that it can no longer be associated with you) for research or statistical purposes, such as determining which pages and Plans are most popular. Aggregated or anonymized information is not considered personal information under this Policy. Where applicable, if Barndominium Plans intends to further process your personal information for a purpose other than that for which it was initially collected, Barndominium Plans shall, prior to such processing, provide you with relevant information on such additional purpose and, to the extent required by applicable law, obtain your consent. To the extent you provide consent to Barndominium Plans for any purpose, you may withdraw such consent at any time by contacting us at the contact information below. We do not collect, use, or sell your personal information to train large language models or other AI models, and we do not permit our service providers to do so.  

Sensitive personal information. The only information we collect that may be treated as sensitive under certain state laws is the payment information you enter at checkout, which is processed by our payment processor; we do not ourselves receive full card numbers. We use it only to complete your transaction and do not sell, share, or use it for inference or advertising. Other than the payment information you provide at checkout, Barndominium Plans does not request or intentionally collect the following types of sensitive personal information: your driver’s license, state identification card, or passport number; your account log-in, debit card, or other payment card number in combination with any required security or access code, password, or credentials allowing access to an account; your religious or philosophical beliefs or associations, political opinions or membership; the contents of your mail, email and text messages, unless we are the intended recipient of the communication; your criminal background; your citizenship or citizenship status; or any personal information about a known child. We ask that you not send or disclose any sensitive personal information that we do not explicitly collect for the purposes outlined in this Policy or to provide our Site and Plans to you.

6. Cookies and Other Technologies. A "cookie" is a small file created by a web server that can be stored on a user's device for use either during a particular browsing session (a "session" cookie) or a future browsing session (a "persistent" cookie). We use cookies, pixels, analytics software, log files, or similar technologies (collectively, "Cookies") to collect certain information about your online activity on the Site. This information allows us to keep track of analytics, enables Barndominium Plans to operate, secure, and improve the Site, and, in the case of the Advertising Cookies described below, allows us to measure and deliver advertising for our Plans. 

The Cookies in use on the Site fall into the following categories:

  • Essential Cookies. The Site operates on the Shopify e-commerce platform, which sets strictly necessary Cookies to maintain your browsing session, secure your shopping cart and checkout, and authenticate platform services. Because the Site cannot function without them, these Cookies cannot be disabled through Cookie Settings.

  • Analytics and Performance Cookies. We use Google Analytics, Microsoft Clarity, and Shopify analytics Cookies to recognize unique visitors across sessions; to understand the pages and Plans visitors view, the paths they take through the Site, and the sources that refer them to us; and to capture interaction data such as click heatmaps and session replays so that we can improve the design and function of the Site.

  • Marketing Automation Cookies. Our email and SMS marketing provider, Klaviyo, sets a Cookie that links your browsing activity on the Site to your email marketing profile if you have subscribed to our emails or SMS alerts, so that we can send you the communications you have requested and tailor them to the Plans and topics that interest you.

  • Advertising Cookies. We work with third-party advertising and social media platforms, including Meta (Facebook and Instagram), TikTok, X (formerly Twitter), Pinterest, Microsoft Advertising, and Google, that set Cookies and pixels on the Site. These Cookies transmit identifiers and information about your browsing activity on the Site to those platforms so that we can measure the performance of our advertising campaigns and show you advertisements for our Plans on those platforms after you visit the Site. The use of these Advertising Cookies constitutes “sharing” of personal information for cross-context behavioral advertising, and may constitute a “sale,” under certain U.S. state privacy laws. You may opt out of this sharing at any time by clicking the “Do Not Sell or Share My Personal Information” link in our website footer, by adjusting your preferences through Cookie Settings (available through the privacy choices link in our website footer), or by enabling an opt-out preference signal such as the Global Privacy Control in your browser, as described in Section 9. We do not share sensitive personal information through Advertising Cookies.

Consent. Before we obtain your consent, we collect only the information strictly necessary to request, document, or manage that consent. We collect additional information through non-essential Cookies only after you have provided valid consent, and only to the extent covered by that consent. You are free to decline non-essential Cookies, but if you do, some parts of the Site may not work properly for you. You may manage preferences via Cookie Settings (available through the privacy choices link in our website footer), and you may disallow Cookies at any time through your web browser. You may also opt out of Google Analytics by installing the browser add-on available at https://tools.google.com/dlpage/gaoptout/, customize the ads Google shows you at https://adssettings.google.com/, and opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at https://optout.aboutads.info/. If you would like more detailed information about first-party and third-party Cookies in use on the Site, please contact us using the information below.

7. How We Disclose Personal Information. We may share or disclose your personal information for the following limited purposes:

  • Third parties providing services on our behalf. We may share information with vendors and suppliers (collectively, “Service Providers”) who perform services and functions on our behalf, such as hosting the Site and processing orders through the Shopify e-commerce platform, payment processing, fulfilling and shipping the Plans you order, delivering our emails and SMS alerts, analytics, customer support, and preparing the Plan modifications you request through designers or drafters engaged by us. The sensitive personal information you provide at checkout (your payment information) is only used by the Service Providers that need it to process your payment. Service Providers do not have the right to use personal information we share with them beyond what is necessary to assist us, and we contractually require that they (1) protect the privacy of your personal information consistent with this Policy and (2) not use or disclose it for any purpose other than providing the limited service or function for Barndominium Plans.

  • Advertising and social media platforms. As described in Section 6, we share identifiers and internet or other electronic network activity information with third-party advertising and social media platforms through Cookies and pixels so that we can measure our advertising and show you advertisements for our Plans on those platforms. These platforms may use the information they receive in accordance with their own privacy policies. We do not share sensitive personal information with these platforms, and you may opt out of this sharing as described in Sections 6, 8, and 9. Mobile phone numbers, SMS opt-in data, and your consent to receive text messages will not be shared with third parties or affiliates for their marketing purposes; we use service providers only to deliver messages on our behalf.

  • Aggregate information. We may share non-identifying information, such as aggregate statistics or usage information, with third parties. Any aggregated information shared in this way will not contain personal information.

  • With your consent. Barndominium Plans may share personal information with third parties when we have your consent to do so. If you agree to have your personal information shared with a third party, it will be subject to that third party’s privacy policy and business practices.

  • At your direction (referrals). If you ask us to connect you with a building kit supplier, builder, or other referral partner, we will provide your name, contact information, and project details to that partner so it can contact you about your project. We may receive a referral fee or commission from the partner if you do business with it. We make these disclosures only at your request, and the partner’s use of your information is subject to its own privacy policy and business practices.

  • Legal Obligations. We may disclose information to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our agreements or policies, including our Terms of Service and the license terms applicable to the Plans; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to our Site, or the public.

  • Transfer in the event of sale or change of control. If the ownership of all or substantially all of our business changes, or we otherwise transfer assets relating to our business or the Site to a third party (such as by merger, acquisition, or bankruptcy proceeding), we may transfer personal information to the new owner. Unless prohibited by applicable law, your information would remain subject to the privacy policy applicable at the time of such transfer.

  • Emergencies. We may disclose personal information to appropriate law enforcement or other emergency response professionals in response to a physical threat to you or others.

Other than the sharing for cross-context behavioral advertising described above and referrals made at your direction as described above, we do not disclose personal information to third parties for their own direct marketing purposes, and we do not sell personal information in exchange for monetary consideration. 

8. Your U.S. State Privacy Rights. Depending on your state of residence, you may have some or all of the following rights with respect to your personal information, subject to the conditions, exceptions, and limitations of the law of your state: 

  • Right to confirm whether we process, and know/access the personal information we have collected about you (including categories, sources, purposes, and third parties to whom it was disclosed). 

    • Request to Access. You may submit a request to obtain a copy of or access to the personal information that we have collected about you.

    • Request to Know. You may request information on the categories of personal information we have collected about you; the categories of sources; our business or commercial purpose for collecting, selling, or sharing personal information; the categories of third parties to whom we have disclosed personal information; and the specific pieces of personal information we have collected about you. You may also request the categories of personal information we have sold or shared and the categories of third parties to whom it was sold or shared, and the categories disclosed for a business purpose and the categories of persons to whom it was disclosed. The categories, sources, and disclosures will not exceed what is contained in this Policy. We are not required to retain information used only for a one-time transaction, to re-identify personal information not stored in that manner, or to provide personal information to you more than twice in a twelve-month period.

  • Right to correct inaccurate personal information. You may correct or update your personal information at any time by contacting us.

  • Right to delete personal information. You may request that we delete personal information we have collected from you. Subject to certain exceptions, we will, on receipt of a verifiable request, delete your personal information from our records, direct our Service Providers to do the same, and notify third parties with whom we have shared it to delete it unless this proves impossible or involves disproportionate effort. To the extent permitted or required by applicable law in your state, we may not delete your personal information if it is necessary to: complete a transaction you requested, including documenting and administering the license granted to you for the Plans you have purchased; protect security and prevent fraud; identify and fix technical errors; comply with legal obligations; conduct internal uses reasonably compatible with the context in which the information was collected; and establish, exercise, or defend legal claims.

  • Right to data portability (a copy in a portable format). You may request a copy of your personal information in a portable and, to the extent technically feasible, readily usable format that you may transmit to another controller.

  • Right to opt out of the sale or sharing of personal information and of processing for targeted advertising or profiling. As described in Sections 6 and 7, we share identifiers and internet or other electronic network activity information, only after receiving your consent, with third-party advertising and social media platforms through Advertising Cookies so that we can measure our advertising and show you advertisements for our Plans on those platforms. This activity constitutes “sharing” of personal information for cross-context behavioral advertising, and may constitute a “sale,” under certain U.S. state privacy laws. We do not sell personal information in exchange for monetary consideration, and we do not use profiling in furtherance of decisions that produce legal or similarly significant effects. At any time, you may withdraw your consent to the use of Cookies or opt out of the sale or sharing of your personal information and of processing for targeted advertising by clicking the “Do Not Sell or Share My Personal Information” link in our website footer, by adjusting your preferences through Cookie Settings (available through the privacy choices link in our website footer), by enabling an opt-out preference signal such as the Global Privacy Control in your browser as described in Section 9, or by submitting a request using the contact information below. 

  • Right to limit the use of sensitive personal information. Through the Site, we collect sensitive personal information only when you make a purchase, consisting of the payment information you provide at checkout. We use and disclose that information only as necessary to process payment for your orders, including by disclosing it to the Service Providers that process your payment, and to meet our recordkeeping and legal obligations. We do not transmit your sensitive personal information through Advertising Cookies, and we do not use it to infer characteristics about you or for advertising. You may withdraw your consent to any use or disclosure of your sensitive personal information at any time by contacting us, although we may be unable to process or fulfill an order without the address and payment information needed to complete it.

If you would like to exercise your rights as a resident of one of these states, submit requests by calling or sending an email using the contact information below, providing enough information to identify you and enough specificity on the requested data. We will verify your request as required by law and respond within statutory timeframes (generally 45 days, extendable). To verify your identity, we may ask you to confirm information we already hold (e.g., email address used to contact us). An authorized agent may submit a request on your behalf by providing signed written permission.

Non-discrimination for exercising your rights. We may not, and will not, treat you differently because of your request to exercise your rights as residents of any state. For those that opt to share personal information, we may offer a financial incentive as described in Section 10, as permitted by law.

9. Opt-Out Preference Signals. While we request consent before collecting unnecessary Cookies, our Site also recognizes Global Privacy Control (GPC) opt-out preference signals and treats a GPC signal as a valid request to opt out of the sale or sharing of personal information and of processing for targeted advertising for the browser or device transmitting the signal and any consumer profile we associate with that browser or device, including your account if you are logged in, and displays a confirmation once your signal has been processed. Because a GPC signal is tied to the browser or device from which it is sent, you may need to enable the signal on each browser or device you use. The signal will not opt you out of the marketing emails or SMS alerts you have requested; you may unsubscribe from those communications as described in Section 11. You may also opt out at any time by clicking the “Do Not Sell or Share My Personal Information” link in our website footer, by adjusting your preferences through Cookie Settings (available through the privacy choices link in our website footer), or by contacting us using the information below. Apart from Global Privacy Control signals, the Site does not currently respond to browser “Do Not Track” signals.

10. Notice of Financial Incentive  


When you interact with our Site, we may offer a discount, promotional code, or other benefit in exchange for your personal information. Participation and sharing your personal information in exchange for the benefit is voluntary and not required to use the Site or to purchase or license Plans.


Summary of the Financial Incentive. From time to time, we offer a promotional sign-up experience on our Site through which you may receive a benefit applied to your purchase of Plans or other services, such as a discount or promotional code redeemable at checkout, when you provide your email address and/or mobile phone number and enroll to receive promotional communications (such as marketing emails, newsletters, and SMS alerts containing Plan updates, building tips, special offers, and new resources) from Barndominium Plans (the “Promotional Offer”). Once you enroll, you will receive a promotional code, which you may enter at checkout to receive the benefit. The promotional codes are each single use and subject to the additional terms, conditions, and expiration dates provided with the promotional code. Because all orders for Plans are final and no refunds are granted, please confirm that your promotional code has been applied before completing your purchase. You must be eighteen (18) years of age or older to be eligible for the Promotional Offer. 


Categories of Personal Information Involved. To receive the Promotional Offer, you must provide your email address and, if you choose to provide it, your mobile phone number, each of which falls within the “Identifiers” category described in Section 5 of this Policy. We use this information, including through the email and SMS marketing provider described in Section 6, to send you the promotional communications you have enrolled to receive and as otherwise described in this Policy. Mobile phone numbers, SMS opt-in data, and your consent to receive text messages will not be shared with third parties or affiliates for their marketing purposes; we use service providers only to deliver messages on our behalf. 


How to Opt-In. Participation in the Promotional Offer is entirely voluntary and requires your affirmative opt-in consent. You opt in by entering your email address and/or mobile phone number when prompted and selecting the applicable submit button. After you opt in, you will receive a promotional code to enter at checkout. Before you opt in, you will be provided with, or directed to, this Notice of Financial Incentive. Consent to receive text messages is not a condition of purchase. If you enroll in SMS alerts, you will receive approximately two (2) to four (4) messages per month, and message and data rates may apply. 


Your Right to Withdraw. You may withdraw from the Promotional Offer at any time. To withdraw, you may unsubscribe by following the directions included at the bottom of any promotional email we send you, by replying STOP (or UNSUBSCRIBE, CANCEL, QUIT, END, REVOKE, OPT OUT), by contacting us at the contact information below, or by submitting a request as described in Section 8 (Your U.S. State Privacy Rights) of this Policy (after which we will send you a message confirming that you have been unsubscribed). We honor opt-out requests within 10 business days.  If you are experiencing issues with the SMS program, you may reply with the keyword HELP for assistance. We will not retaliate against you, deny you goods or services, charge you different prices or rates, or provide you a different level or quality of goods or services because you decline to participate in, or withdraw from, the Promotional Offer.  


Value of Your Personal Information and How the Incentive Relates to That Value. California law permits us to offer a financial incentive only if the difference in price is reasonably related to the value of your personal information to us, and requires us to provide a good-faith estimate of that value and a description of the method we used to calculate it. We have made a good-faith estimate that the value of the personal information we collect through the Promotional Offer is reasonably related to the value of the benefit we provide. We estimate that the value to Barndominium Plans of a subscriber’s email address and/or mobile phone number, together with enrollment in our promotional communications, is approximately $19 per subscriber per year. We calculated this by dividing the revenue from orders attributed to our marketing emails and SMS alerts during the twelve months ending September 2026 (approximately $663,000) by the number of new subscribers who enrolled during the same period (approximately 34,900). The Promotional Offer awards one of the following prizes, each redeemable only with the purchase of a house plan: a foundation change (retail value $350; 13% chance), a CAD file (retail value $975; 12% chance), a material list (retail value $375; 15% chance), printed plans (retail value $250; 35% chance), or 10% off (approximately $85 on a stock plan; 25% chance). The average retail value of a prize is approximately $328. Because a prize has value only if it is redeemed with a purchase, and fewer than one percent of prizes awarded have been redeemed, the average value of the benefit per enrolled subscriber is approximately $1 to $3, which is less than our estimate of the value of the subscriber’s personal information to us. We therefore believe the benefit is reasonably related to the value of the personal information provided.


11. Newsletters and Emails.

Newsletters and emails. At various times during your use of the Site, including when you make a purchase or enroll in the Promotional Offer described in Section 10, you may be given the option of opting in to recurring informational or promotional newsletters and marketing emails from Barndominium Plans, such as Plan updates, building tips, special offers, and new resources. We deliver these communications through the email and SMS marketing provider described in Section 6, which acts as our Service Provider. When you provide your email address or sign up for one of our mailing lists, you may at any time choose to opt out of receiving additional informational or promotional newsletters or marketing emails by following the unsubscribe directions included at the bottom of each email or by contacting us at the contact information below. We will process unsubscribe requests within ten (10) business days. Even if you opt out of marketing communications, we may still send you transactional or administrative messages relating to your orders or the Site, such as purchase confirmations and messages concerning the delivery of the Plans you have ordered.

SMS alerts. If you opt in to receive SMS alerts from Barndominium Plans, you will receive recurring text messages containing Plan updates, building tips, special offers, and new resources. Consent to receive text messages is not a condition of purchase. You will receive approximately two (2) to four (4) messages per month, and message and data rates may apply; if you have questions about your text or data plan, please contact your wireless provider. Carriers are not liable for delayed or undelivered messages. You may cancel SMS alerts at any time by replying STOP (or UNSUBSCRIBE, CANCEL, QUIT, END, REVOKE, OPT OUT), or by contacting us using any method in Section 17, after which we will send you a message confirming that you have been unsubscribed and you will no longer receive SMS messages from us. We will process unsubscribe requests within ten (10) business days. If you wish to rejoin, you may sign up again as you did the first time. If you are experiencing issues with the SMS program, you may reply with the keyword HELP for assistance or contact us at the contact information below. Mobile phone numbers, SMS opt-in data, and your consent to receive text messages will not be shared with or obtained from third parties or affiliates for their marketing or promotional purposes; we use service providers only to deliver messages on our behalf. 

Communications with us. When you communicate with us, including when you submit a Plan-modification request or send us sketches, measurements, lot information, or other materials in connection with a requested modification, we may retain your communications and materials to process and respond to them, to prepare and document the modifications you request, and to improve the Site and our customer support. Plan-modification requests and the materials you submit with them are also subject to our Terms of Service.

12. Security of Your Information. The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. The billing and payment information you provide at checkout is transmitted to the e-commerce platform and payment processor described in Section 7 using industry-standard encryption (TLS), and the payment information you provide at checkout is used only by those Service Providers that need it to process your payment. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and Barndominium Plans cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security. If a breach of security involving personal information occurs, we will comply with all applicable breach-notification laws. If you believe you have identified a security vulnerability in the Site, please report it to us at the contact information below. Do not access, modify, or delete data belonging to others or disrupt the Site when investigating or reporting a potential vulnerability. If you believe any personal information you have submitted to us is not secure, please notify us immediately at the contact information below.

13. Retention of Personal Information. We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, as described in Section 5 and this Section 13, and then delete or de-identify it when it is no longer needed. We retain records of your orders, the Plans you have purchased or licensed, your order history, and the billing and shipping information you provide at checkout for as long as necessary to process, fulfill, ship, and document your order; to administer the license granted to you for the Plans, including any Plan modifications you request; to respond to your inquiries; and to meet applicable recordkeeping, tax, accounting, and legal obligations. Because all orders for Plans are final and the license granted to you continues until you complete or abandon your project, we may retain purchase and license records for the duration of the license and for the period needed to maintain appropriate business and accounting records and to establish, exercise, or defend legal claims. We retain Plan-modification requests and the sketches, measurements, lot information, and other materials you submit with them for as long as necessary to prepare and deliver the requested modifications, to document the work performed, and to meet our recordkeeping and legal obligations. We retain the content of your inquiries and other communications with us for as long as necessary to respond to them and to meet applicable recordkeeping and legal obligations. We retain your email address, mobile phone number, and related subscription preferences for as long as you remain subscribed to our newsletters, marketing emails, or SMS alerts, and thereafter only as needed to honor your opt-out request and to meet our legal obligations. Information collected automatically through Cookies, including your IP address, browser and device information, and website logs, is typically retained for a shorter operational period; the Cookies described in Section 6 expire at the end of your browsing session or after a set period depending on the Cookie, and you may delete them at any time through your browser. To determine the appropriate retention period, we consider: the amount, nature, and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we obtained the information and whether we can achieve those purposes through other means; whether the information is needed to provide the Plans and Plan modifications you have ordered, to improve the Site, and to respond to your inquiries; the need to maintain appropriate business and accounting records; compliance with our legal, regulatory, and contractual obligations; and our rights to establish, exercise, or defend legal claims. When personal information is no longer needed, we will delete, destroy, de-identify, or anonymize it in accordance with standard retention practices, subject to legal hold, backup retention, or other legal, regulatory, contractual, or operational obligations. 

14. Linked Sites. The Site may contain links to third-party owned or operated websites, including social media websites and publications hosted on such third-party websites (each a "Linked Site"), as a convenient method of accessing information that may be useful to you. When you click on a link to a Linked Site, you will leave the Site, and another entity may collect personal information or anonymous data from you. The inclusion of a link does not imply our endorsement of the Linked Site, and your use of any Linked Site is at your own risk. This Policy does not apply to Linked Sites; they have separate privacy and data collection practices, and we have no responsibility or liability relating to them. We encourage you to review the privacy policies of any Linked Sites you visit so that you can understand how those websites collect, use, and share your information.

15. Changes to Our Privacy Policy. We reserve the right to change or modify this Policy at any time.  Any nonmaterial changes are effective upon being posted unless we advise otherwise. If we make any material changes to this Policy, we will notify you by email or post notice on the Site before the change becomes effective. Material changes will be effective thirty (30) days after we provide notice, except changes relating to new features or required by law, which are effective immediately. Use of information we collect is subject to the Policy in effect at the time such information is used. We encourage you to frequently review this Policy.

16. Reasonable Fees. Subject to applicable law, Barndominium Plans may charge a reasonable fee for the administrative costs of any request that is manifestly unfounded or excessive.
